Judge dismisses one case, sends 2 others to state court

A federal judge has ordered two lawsuits filed by the families of deceased Fallon leukemia cluster patients be returned to state court and dismissed a third-party lawsuit against the Navy filed by a Fallon metals firm.

Judge to decide forum for Fallon leukemia lawsuits

A federal judge on Thursday heard arguments in the Fallon child leukemia lawsuits and will decide whether the toxic torts are heard by state or federal courts.
Federal courts have stricter pre-trial standards for such lawsuits, which could mean the Fallon litigation might not reach trial in a federal venue.
The wrongful death claims involve two children who died in 2001, part of a cluster of 17 patients diagnosed with leukemia in the Fallon area since 1997.
